Is MyFax HIPAA compliant?
None of MyFax's three plans, $8.25 to $37.50 a month billed annually, names a BAA, and its terms bar storing PHI until one exists. Fax Pigeon Basic is $4.99 a month billed annually with a signed BAA.

MyFax's terms bar storing protected health information (PHI) with the service until you have executed a Business Associate Agreement (BAA) with the company, and none of its three plans, $8.25 to $37.50 a month billed annually, names one. Whether MyFax is HIPAA compliant for your practice therefore depends on an agreement its pricing page never mentions. Fax Pigeon sells HIPAA fax, so read this as a seller's comparison. Every Fax Pigeon plan includes a signed BAA, executed at signup.
Which MyFax plan comes with a BAA?
None of the three. MyFax's pricing page lists Home Office User, Small Business User and Power User with no BAA line and no HIPAA line. Its FAQ answers its security question by sending buyers who want HIPAA-compliant cloud faxing to its partner eFax Corporate. Its Corporate page, which names no BAA either, sends visitors who are not NextGen Healthcare customers to eFax Corporate too. A MyFax blog post on cloud faxing, last updated September 13, 2023, tells readers to confirm they are on a HIPAA-compliant tier of whichever cloud fax service they pick, and it names no MyFax plan as one.
None of these pages links an agreement a practice could read before subscribing. Is eFax HIPAA compliant? covers eFax's side.
What does MyFax's contract say about patient information?
The Terms & Conditions are a contract with Consensus Cloud Solutions Canada ULC, effective October 7, 2021 for current users. They mention PHI once. In section 7, customers agree not to use the service to store it "unless and until you have executed a Business Associate Agreement" with the company for the applicable service. The terms do not say how to ask for that agreement or what it covers.
Section 3 adds that received faxes are stored and displayed in MyFax Central while the account is active, unless the customer switches that off in preferences. The company can also change how many days it keeps them.
HIPAA defines a business associate by what a vendor does for a covered entity: it creates, receives, maintains or transmits PHI on the entity's behalf (45 CFR 160.103). A covered entity may allow that when it obtains satisfactory assurance that the vendor will safeguard the information, documented in a written contract or other written agreement (45 CFR 164.502(e)). The Security Rule sets the same condition for electronic PHI (45 CFR 164.308(b)).
Which Fax Pigeon plan matches each MyFax plan?
MyFax prints sending and receiving as two lines on each card. Fax Pigeon counts sent and received pages against one monthly budget. The table sets each MyFax plan beside the Fax Pigeon plan with the same pages or more.

MyFax counts each transmission as the greater of its actual pages or its full and partial 60-second increments (section 2), so a slow page can use more than one page of the allowance. Every Fax Pigeon plan includes every feature. The plans differ only in pages a month and the extra-page rate.
Do you keep a MyFax fax number when you leave?
A number MyFax issued stays with MyFax. A number you ported in can leave, on conditions.
MyFax is the customer of record for every MyFax number, and section 18 gives you a revocable permission to use one for the term of the agreement. Under section 18(b), the number may be reassigned to another customer immediately after the service ends. For a number MyFax issued, section 18 bars moving it to another provider, and a violation costs $500 in liquidated damages. A number you ported in can leave only under section 18(a): written notice to MyFax no later than 30 days after the account ends, your new carrier's porting request inside that window, a paid balance, and a $40 fee per number. The terms say to keep the account active until the port finishes if you want service in the meantime.
Every paid Fax Pigeon plan includes your own dedicated fax number. Porting in is free, and so is porting out.
What would change the answer?
A written BAA from MyFax that names the plan you pay for, in hand before the first patient fax. Section 7 puts the same step first, and 45 CFR 164.502(e) calls for the written agreement.
Who should switch from MyFax?
- A practice that sends or receives patient records through MyFax. Every Fax Pigeon plan includes a signed BAA, executed at signup, and the free first fax (up to 10 pages) falls under the same agreement. At 200 pages, Basic is $5.99 a month, or $4.99 billed annually.
- A team of more than five. MyFax's FAQ allows up to 5 email addresses to send and receive. Fax Pigeon includes unlimited people at no extra cost, with a shared inbox that has roles and assignment.
- A practice that wants a refund path. MyFax's terms call service fees non-refundable (section 15). Fax Pigeon gives a full refund within 72 hours of the first payment (once per customer), and you cancel anytime in Settings and keep service to the end of the paid period.
If you ported the number into MyFax, start the port at Fax Pigeon from Settings while the MyFax account is open. The port costs nothing on a paid plan, and the number stays active at MyFax for the 5 to 15 business days most transfers take. If MyFax issued the number, its terms bar porting it out, and your Fax Pigeon plan gives you a new dedicated number. The port-before-cancel steps give the order. The pricing page lists all six Fax Pigeon plans, and online fax services that sign a BAA lists the services that do.
* Prices last verified October 7, 2026, at each provider's own site. Fax Pigeon is not affiliated with MyFax or Consensus Cloud Solutions.
