Is a plan labeled HIPAA compliant the same as a plan with a BAA?

No: a plan can carry a HIPAA compliant label and still have no BAA at all, and HHS and OCR say they "do not certify any persons or products as 'HIPAA compliant.'" HHS's cloud computing guidance says a covered entity that has a cloud service maintain electronic PHI without a BAA is in violation of the HIPAA Rules, citing 45 CFR 164.308(b)(1) and 164.502(e).

eFax Personal is the plan in this comparison that carries the label without the agreement: its card lists HIPAA Compliant and prints no BAA line. eFax's Customer Agreement limits its BAA to the "Secured Service", defined as eFax Business, eFax Protect or eFax Unite, and has customers agree not to store protected health information on any other eFax service.
