HIPAA fax for medical billing companies

A medical billing company is a business associate. The fax service it uses to move claims, authorizations and records is the biller's own business associate in turn, and it has to sign a Business Associate Agreement before the first page goes out. The rule, in one paragraph

HIPAA's definition of a business associate (45 CFR 160.103) covers a person or company that creates, receives, maintains or transmits protected health information on behalf of a covered entity. That is a billing company. A business associate must have a written agreement with the covered entity it serves, and it must have one with any subcontractor that handles the information for it. A fax vendor that transmits your clients' claims and records is that subcontractor. No signed agreement, no lawful fax.
