Is Sfax HIPAA compliant?

Sfax prints 'BAA Available' on Plus ($62 a month), Contender and Enterprise but not on Standard ($37), and its help center says to email or call. Fax Pigeon signs a BAA at signup on every plan.

Sfax can carry patient information once it has signed a BAA with you, and its sign-up page prints "BAA Available" on Plus ($62 a month), Contender ($125) and Enterprise but not on Standard ($37). Sfax's help center routes the agreement through an email or a call, and its terms say you do not own the number. Fax Pigeon sells HIPAA fax, so read this as a seller's comparison. Every Fax Pigeon plan includes a signed BAA, executed at signup.

Which Sfax plans print a BAA?

Sfax's sign-up page says "All our faxing plans are HIPAA Compliant." Its plan cards add "BAA Available" to three of the four.

Sfax planMonth to monthPages a monthBAA line on the cardFax Pigeon plan, same pages or moreMonth to month
Standard$37350NoneStandard, 500 pages$11.99
Plus$62700BAA AvailablePlus, 1,000 pages$17.99
Contender$1251,500BAA AvailablePro, 2,000 pages$33.99

Pages are sent plus received on both. Billed annually, Sfax is $34, $57 and $115 a month, with 10¢ a page past each limit. Fax Pigeon's Standard, Plus and Pro are $9.99, $16.99 and $29.99 billed annually, and extra pages are 5¢, 4¢ and 3.5¢. The Enterprise card (2,500+ pages) is a quote. Sfax lists unlimited users, and Fax Pigeon includes unlimited people at no extra cost.

How do you get a BAA from Sfax?

By email or phone. The Sfax help article says: "If you wish to fill out a BAA with Sfax to have on file, please email support@sfax.com or call us at 877-493-1015." Sfax's HIPAA page says "We will sign a BAA as your HIPAA fax partner." Neither page links the agreement text, and neither names a plan limit.

Sign-up and the BAA are separate steps. The 14-day trial starts on the sign-up page, and the BAA starts with the email or call. Sfax's own article says PHI cannot go to a business associate "unless both parties have a business associate agreement in place."

HIPAA puts the same condition on the practice. A covered entity may let a business associate handle PHI "if the covered entity obtains satisfactory assurance," documented through "a written contract or other written agreement" (45 CFR 164.502(e)). The "HIPAA Compliant" line on a sign-up page labels a plan. The written agreement is the document the rule calls for (HHS).

What do Sfax's terms say about the number, refunds and cancellation?

From Sfax's Terms and Conditions, issued by Consensus Cloud Solutions, and its help center:

  • The number is not yours. "You understand and agree that you are not the owner of any Sfax fax number," and after the account ends the number may be assigned to another customer. Sfax may also change the number it assigned you, for an area code split or any other reason.
  • No refunds after the trial. "Refunds can not be issued after your initial 14-day trial," and Sfax does not prorate partial months (help center).
  • Cancellation takes notice. A customer may cancel "with 30 days written notice" by emailing billing@sfax.com, and the account ends at the end of the next billing cycle after the notice. For monthly plans the help center says you are billed for the 30 days from the date the notice arrives.
  • One page can bill as several. Per-page prices rest on a 60 second transmission time, and pages that take longer "may be charged as multiple pages."
  • The terms can change. Sfax may update them "at any time without notice to you."

What would make Sfax compliant for your practice?

A BAA on file for the plan you pay for, before the first patient fax. Email or call Sfax, ask which plan the agreement covers, and keep the signed copy. A practice on Standard should ask whether the $37 plan is covered, because its card carries no BAA line.

Who should switch from Sfax?

  • A practice on Standard, $37 a month for 350 pages, where the card prints no BAA line. At 500 pages Fax Pigeon's Standard plan is $11.99 with the BAA signed at signup.
  • A practice that wants a refund path. Fax Pigeon gives a full refund within 72 hours of the first payment (once per customer), cancels anytime in Settings and keeps service to the end of the paid period.
  • A practice that wants its number to stay its own. Fax Pigeon ports numbers in and out free, and every plan includes your own dedicated fax number.

Start the port at Fax Pigeon from Settings while the Sfax account is open. Sfax's porting article says outbound porting is "at no charge" and that you "MUST keep your Sfax service active" until the number moves. Porting into Fax Pigeon is free on a paid plan and takes most transfers 5 to 15 business days with Sfax serving the number meanwhile, and what happens to the number during a port has the order. The pricing page lists all six Fax Pigeon plans.
